Terms of Service

Hi. These are the rules of using Momentory — written in plain English. Read them. They're shorter than most. By creating an account, you agree to them.

Momentory is operated by NorthBuilt Studios, based in Canada ("we", "us", "Momentory").

What Momentory is

Momentory is a private digital baby book. You upload photos and captions of your family moments, your invited family members can see them, and we keep it organised. That's the service. We do not sell ads, we do not sell your data, we do not use your photos to train AI.

Your account

Your content

You own your content. Photos, captions, comments, the lot. Adding it to Momentory does not transfer ownership to us.

To actually run the service — store your photos, show them to the family members you've invited, make backups, generate thumbnails — we need a limited licence from you. You grant Momentory a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and modify (only as needed for storage and display — e.g. resizing for thumbnails) your content, solely for the purpose of providing the service to you and the family members you've invited. This licence ends when you delete the content or your account.

We don't claim any other rights. We don't use your content for marketing. We don't license your photos to third parties.

What you must not upload

You agree not to upload, post, or share through Momentory anything that:

Copyright takedowns (DMCA)

If you believe content on Momentory infringes your copyright, send a DMCA-compliant notice to support@momentory.family. Include:

We will respond to valid notices by removing the material and notifying the uploading user. Users who repeatedly infringe will have their accounts terminated. If you believe your content was removed by mistake, you can submit a counter-notice using the same email.

Our designated DMCA agent registration with the US Copyright Office is in progress; the email above is the operative contact in the interim.

Subscriptions, billing, and cancellation

Deleting your account

You can delete your account at any time via Settings → Account → Delete. There's a 30-day grace period during which you can change your mind. After 30 days, your account, your family's archive (if you're the sole admin), your photos, captions, comments, child profiles, and chat history are permanently and irrecoverably deleted.

Families with multiple admins continue without the user who left; only data unique to that user is deleted.

Termination by us

We may suspend or terminate your account if you violate these terms — particularly the "What you must not upload" section — or if we're required to by law. We'll give you notice and a chance to respond where it's reasonable to do so, except in cases involving CSAM, imminent harm, or legal compulsion, where we may act immediately.

Service availability

We aim for high uptime but we don't guarantee perfection. We may have planned maintenance windows and unplanned outages. We may also discontinue features. If we discontinue the service entirely, we'll give you reasonable notice and a way to export your data.

Limitation of liability

The service is provided "as is." To the maximum extent permitted by applicable law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement). Your statutory rights as a consumer are not affected.

To the maximum extent permitted by law, Momentory's total liability to you in connection with the service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the liability, or (b) CAD $100. We will not be liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these terms excludes liability we can't legally exclude — including for fraud, gross negligence, or for any liability that applicable consumer protection law prohibits us from disclaiming.

Governing law and disputes

These terms are governed by the laws of Canada, without regard to conflict-of-laws rules.

Any dispute that we can't resolve informally will be resolved in Canadian courts, except where applicable law gives you the right to bring a claim in your own jurisdiction (which we honour).

Changes to these terms

When we change these terms materially, we bump the version number and re-prompt you to accept on next sign-in. The effective date at the top of this page reflects the current version.
